These Terms of Service ("Terms") govern your access to and use of Visaflow's immigration case management platform, websites, and related services (collectively, the "Services"). By creating an account or using our Services, you agree to these Terms and our Privacy Policy.

Visaflow reserves the right to modify these Terms at any time. We will notify you of any material changes by email or through our platform. Continued use of our Services after such changes constitutes acceptance of the updated Terms.

Visaflow provides a cloud-based software platform designed for immigration professionals. Our Services include:

• Case management and tracking tools
• Client portal and communication features

• Calendar and scheduling functionality
• Reporting and analytics
• AI-powered assistance features

3. Account Registration

To use our Services, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains accurate and up-to-date

Certain features of our Services require payment. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as described during checkout
• Provide current, complete, and accurate billing information
• Automatic renewal of subscriptions unless cancelled before the renewal date
• No refunds for partial billing periods, except as required by law

We reserve the right to change our pricing with 30 days' notice. Changes will apply to the next billing cycle.

5. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Use the Services for fraudulent or deceptive purposes
• Share your account credentials with third parties
• Resell or redistribute our Services without authorization

6. Data Ownership and Responsibility

You retain ownership of all data you upload to the platform (Your Data"). You grant Visaflow a limited license to host, process, and display Your Data solely to provide the Services.

You are responsible for:

• The accuracy and legality of Your Data
• Obtaining necessary consents from clients before uploading their personal information
• Complying with all applicable data protection laws, including POPIA
• Maintaining appropriate backups of Your Data

7. Intellectual Property

Visaflow and its licensors own all rights, title, and interest in and to the Services, including all software, designs, trademarks, and content. These Terms do not grant you any rights to use Visaflow's branding or trademarks without prior written consent.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELORA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid to Visaflow in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Visaflow and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any rights of a third party.

Either party may terminate these Terms at any time. Upon termination:

• Your access to the Services will be suspended
• You may export Your Data within 30 days of termination
• We will delete Your Data after 90 days, unless legally required to retain it
• Accrued payment obligations remain due

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

12. POPIA Compliance

Visaflow operates in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). As a user of our Services, you acknowledge that you are also bound by POPIA when processing personal information of your clients through our platform.
